Scope and validity of the terms
1.1. The Terms and Conditions apply to the legal relations arising between a person (hereinafter the Customer) and the owner of the shopping environment mymagic.ee (hereinafter E-shop) my Magic OÜ (hereinafter Merchant) when purchasing products through E-shop.
1.2. In addition to these terms and conditions, the legal relations arising from the purchase of products through E-shop are regulated by the legislation in force in the Republic of Estonia.
2.Products
2.1. The prices of the products are in Euros and include 20% VAT.
2.2. Product prices and availability are subject to change without notice.
2.3. The pictures of the products in the E-shop are for illustrative purposes only and may differ from the actual products.
2.4. Product descriptions may not be exhaustive and may contain errors.
3.Payment for products
3.1. The prepayment invoice will be sent to the customer as an order confirmation by e-mail. Before paying the prepayment invoice, the customer is obliged to check that the data on the prepayment invoice correspond to the order. The execution of the order will start from the moment when the entire amount indicated on the prepayment invoice has been received in the Merchant's current account.
4. Delivery of products
4.1. The cost of delivery of products within Estonia is according to the service: goods with Omniva 3€, Itella SmartPOST 2,95€. Delivery to Finland 12€ and to Latvia 6€.
4.2. Before placing an order, the customer is obliged to check the correctness of the contact information provided in order to avoid delays and misunderstandings during the delivery of the products. The Merchant shall not be liable for delays in the delivery of products and misunderstandings if the delay or misunderstanding is due to the inaccuracy or inaccuracy of the information provided by the Customer when placing the order.
5. Liability and force majeure
5.1. The Merchant and the Customer shall be liable to each other for the damage caused to the other party by the violation of these terms and conditions in the cases and to the extent provided by the legislation in force in the Republic of Estonia.
5.2. The Merchant shall not be liable for damages caused to the Customer or for the delay in the delivery of the product if the damage or the delay in the delivery of the product is due to a circumstance which the Merchant could not, did not foresee or could not have foreseen (force majeure). The trader's liability for the delivery of the goods ends from the moment the goods are handed over to the customer or the transport company.
6. Other conditions
6.1. All personal data of the customer received during the visit to E-shop and making purchases are treated as confidential information. The Merchant shall not disclose the information that has become known to him to a third party.
6.2. Disputes arising between the Customer and the Merchant in connection with ordering and purchasing products through E-shop shall be resolved through negotiations. If no agreement is reached, the Customer has the right to turn to the Consumer Protection Board or Harju County Court to protect their rights. Disputes and issues not specified in these terms and conditions shall be resolved in accordance with the legislation in force in the Republic of Estonia.
7. Return of goods
7.1. If upon receipt of the goods it turns out that the goods do not meet your expectations or the goods do not fit, you have the right to return the goods within 14 days of receipt. The goods to be returned must be in the original packaging, with labels and unused.
